Terms of Service
By accessing and using the Walk For A Hero website, you agree to these terms and conditions.
About the Foundation
Walk For A Hero Foundation is a registered 501(c)(3) nonprofit organization. Donations are tax-deductible to the extent allowed by law.
Eligibility
You must be at least 18 years old to register as a walker, to set up a portal, or to make a donation. A minor may take part in a walk only under the account and supervision of a parent or legal guardian, who accepts these terms on their behalf. This website is not directed to children under 13 and we do not knowingly collect personal information from them; if we learn that we have, we will delete it. If you believe a child has given us information, email glenn@walkforahero.com.
Use of the Website
You agree to use this website for lawful purposes only. You may not use the site in any way that could damage, disable, or impair the website or interfere with another user's use.
Donations
All donations are voluntary. The Foundation reserves the right to allocate funds as needed to best serve its mission of providing exoskeletons for paralyzed veterans. Donations are processed by Stripe; the amount, currency and frequency shown to you at checkout are the amount, currency and frequency you will be charged, and your receipt comes by email.
Monthly Giving
If you choose to give monthly, you are authorizing us to charge the payment method you gave at checkout the amount you chose, once a month, until you cancel. There is no fixed number of payments and no end date: a monthly gift continues until it is cancelled or the payment method stops working. The amount and the monthly frequency are shown to you before you confirm, and again on the receipt you receive for each payment.
How to cancel. Email glenn@walkforahero.com, or write to us through the contact page, and say that you want to stop your monthly gift. We will cancel it and email you to confirm. We aim to do this within two business days, and we will always do it before your next monthly charge if you tell us at least three business days beforehand. There is no fee and no cancellation penalty, and we will not ask you to justify the decision.
We would rather you cancelled than disputed a charge with your bank, so if something is wrong, tell us — we will fix it. Cancelling stops future payments; it does not by itself refund payments already made. See Refunds below for that.
You can also change the amount of a monthly gift by asking us: we will cancel the existing one and set up the new amount.
Refunds
A donation is a gift, so donations are generally final. We would still much rather correct a mistake than keep money a donor did not mean to give.
If you gave the wrong amount, gave twice by accident, meant a one-time gift and set up a monthly one, or did not authorize the charge at all, email glenn@walkforahero.com within 30 days of the charge and we will refund it in full. After 30 days, write to us anyway and we will consider the request on its merits. Refunds go back to the original payment method and typically appear within five to ten business days, depending on your bank. A refunded donation is not tax-deductible, and if you have already received an acknowledgement for it we will issue a correction.
Where a donation was made against a specific hero's goal and has already been applied to it, a refund reverses that credit as well.
Walker Participation
Walkers participate at their own risk. The Foundation is not liable for any injury, accident, or loss that may occur during walk tracking or related activities. Walkers are responsible for their own safety and should follow all traffic and pedestrian laws. Please do not look at your phone while you are moving — the tracker is designed to run in your pocket, and it keeps recording while your screen is locked.
Location tracking and your consent. The walk tracker records your precise location — latitude, longitude and the time of each reading — for the whole time a walk is running, and that route is how your miles are measured and credited. By starting a walk you consent to that recording. We ask your device for your location only while a walk is in progress, never when you are simply using the site, and you can refuse or withdraw the location permission through your phone or browser at any time; without it the tracker cannot record a walk.
Publishing a route is your choice. Sharing your live position and your finished routes publicly is off unless you switch it on in your Walker portal. If you switch it on, the routes you share — with their timestamps — can be viewed by anyone on the internet, and a route usually starts and finishes where you set out from. Please read the Privacy Policy before you turn it on. Switching it off stops us publishing further walks but does not by itself take down a route you already shared; email us and we will remove it.
Honest miles. Miles must be walked. Distance that moves faster than a person can travel on foot is not credited, walks are recomputed on our servers rather than taken on trust, and sessions that look wrong are reviewed by a person. We may decline to credit, or reverse, miles we believe were not walked, and we may suspend a walker who repeatedly submits them.
Pledges and Backers
A pledge is a commitment to give a set amount for each mile your walker completes, and it is charged once, to the card you pledged with, only after the walker completes their miles and presses Complete. Walkers never handle money. We work out what a pledge produces from the rate you agreed and the miles our own records verify — never from a figure supplied by a walker's device.
There is a ceiling, and it is the number you did the arithmetic on. The walk is a 15-mile mission, so a pledge cannot produce more than your per-mile rate multiplied by 15 miles — even if your walker goes further. You can also set a lower maximum when you pledge. Miles beyond the ceiling still count for the walker's own record and the leaderboard; they are simply not charged to you.
If a walk is later reviewed and voided, its miles and any amount they produced are reversed.
Intellectual Property
All content on this website — including text, images, logos, and design elements — is the property of Walk For A Hero Foundation unless otherwise noted. You may not reproduce or distribute our content without permission. Heroes and walkers keep the rights to the photographs and words they submit, and grant us permission to publish them on this site and in the Foundation's materials; that permission can be withdrawn by asking us.
Limitation of Liability
The Foundation provides this website "as is" without warranties of any kind. To the fullest extent permitted by law, the Foundation shall not be liable for any damages arising from your use of the website.
Your Privacy Rights
How we handle your information is set out in the Privacy Policy, which forms part of these terms.
Wherever you live, you can ask us for a copy of the personal information we hold about you, ask us to correct it, or ask us to delete it. California residents have those rights under the California Consumer Privacy Act, as amended, together with the right to limit our use of sensitive personal information — which includes the precise location recorded during a walk. Residents of the United Kingdom and the European Economic Area have rights of access, correction, deletion, restriction, objection and portability under the UK GDPR and the GDPR, and may withdraw consent where our use rests on it, as it does for publishing walk routes. We do not sell personal information or share it for cross-context behavioural advertising, and we will not treat you differently for exercising any of these rights.
To exercise any of them, email glenn@walkforahero.com from the address you used with us, saying what you would like us to do. We may need to verify who you are before acting, particularly on a deletion request, and an authorized agent may make a request on your behalf. We will respond within the period the applicable law allows.
Security and Notification
We take reasonable measures to protect the information you give us, but no website can promise perfect security. If we discover a breach of security affecting your personal information, we will notify you and the relevant authorities as required by applicable law, without undue delay, and tell you what happened and what we are doing about it.
Governing Law and Venue
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising out of these terms or your use of this website will be brought exclusively in the state or federal courts located in Broward County, Florida, and you and the Foundation each consent to the jurisdiction of those courts. Nothing here prevents you from bringing a matter before a consumer-protection or charity regulator in your own state or country.
Changes to These Terms
We may update these terms from time to time. The date at the foot of this page tells you when they last changed. Continued use of the website after changes constitutes acceptance of the updated terms. If a change materially affects a monthly gift you have set up, we will email you before it takes effect.
Contact
If you have questions about these terms, please contact us or email glenn@walkforahero.com.
